Section 1225.1 - Definitions

As used herein:

(a) Automotive vehicle shall mean any highway vehicle which is self propelled, and shall include the combination of a tractor and semi-trailer.
(b) Day shall mean a period of 24 hours, or any fraction thereof, beginning at midnight.
(c) Driver shall mean the person who is in actual physical control of a vehicle.
(d) Executive director shall mean the executive director of The Port Authority of New York and New Jersey or his successor in office or duties.
(e) Freight shall include all commodities as listed in the National Motor Freight Classification No. 9 (MF-I.C.C. No. 17) issued by C. F. Jackson, agent, and on file with the Interstate Commerce Commission, including all reissues thereof or supplements thereto; except the following, which are excluded:
(1) Commodities which cannot physically be handled at a truck terminal;
(2) Commodities in bulk;
(3) Commodities subject to deterioration, damage or spoilage due to atmospheric or other weather conditions;
(4) Commodities requiring refrigeration, ventilation or heating;
(5) Live animals, birds, fish and reptiles;
(6) Class A explosives, Class B explosives or Class A poisons, all as defined in the I.C.C. regulations;
(7) Baled fibres, including but not limited to, sisal and hemp (except when permission to handle the same has been obtained in advance);

provided, however, that by notice given within 60 days after the effective date of any such reissue or supplement, the Port Authority may exclude any commodity first listed therein.

(f) Freight handling vehicle shall mean any vehicle used only within a truck terminal.
(g) Highway vehicle shall mean any vehicle used both within and without a truck terminal.
(h) Holiday shall mean New Year's Day; Lincoln's Birthday; Washington's Birthday; Memorial Day; Independence Day; Labor Day; Columbus Day; Election Day; Armistice Day; Thanksgiving Day and Christmas Day.
(i) I.C.C. regulations shall mean the regulations of the Interstate Commerce Commission in effect on the effective date hereof, issued under the authority contained in sections 831-835, inclusive, of title 18 of the U. S. Code, entitled "Crime and Criminal Procedure", and included in parts 71 to 85, inclusive, of title 49 of the Code of Federal Regulations, dealing with the transportation of explosives and other dangerous articles by motor carriers by highway.
(j) Operator shall mean the owner of a vehicle, or any person who has rented such vehicle for operation by himself or his own agents.
(k) Parking shall mean the halting of a vehicle on a roadway or other area while not actually engaged in receiving or discharging freight, unless in obedience to traffic regulations or traffic signs or signals, and regardless of whether or not the driver remains in the vehicle.
(l) Permission shall mean permission granted by the superintendent, unless otherwise specifically provided.
(m) Person shall mean any individual, firm, copartnership, corporation, association or company (including any assignee, receiver, trustee or similar representative thereof) or the United States of America or any State or political subdivision thereof, or any foreign government or political subdivision thereof, or the United Nations.
(n) Port Authority shall mean The Port Authority of New York and New Jersey.
(o) Port Authority rules and regulations shall mean the rules and regulations set forth in this Part and any future amendments and supplements.
(p) Semi-trailer shall mean a highway vehicle, not self-propelled, designed and constructed to be towed and to move with the forward end of its body or chassis resting upon the body or chassis of the towing vehicle.
(q) Superintendent shall mean the Port Authority official in charge of the particular truck terminal, or the person properly delegated to perform his functions and duties.
(r) Ton shall mean 2000 pounds avoirdupois.
(s) Tractor shall mean an automotive vehicle designed for drawing other highway vehicles and having no provision for carrying loads independently.
(t) Trailer shall mean a highway vehicle (other than a semi-trailer) not self-propelled, designed and constructed to be towed.
(u) Truck shall mean an automotive vehicle designed or used for the transportation of freight, or registered for such use.
(v) Truck terminal shall mean:
(1) Union Terminal Freight Station No. 2, located in the Borough of Manhattan and bounded by Greenwich, West Houston, Washington and Spring Streets;
(2) Union Terminal Freight Station No. 3, located in Newark, New Jersey, north of Delancy Street, east of New Jersey State Highway Route 25, and south of Bears Stadium.
(w) Truck terminal platform shall mean that area of a truck terminal used for the handling of freight and incidental storage, excluding storage rooms and the cooperage room.
(x) Truck terminal ramps shall mean the two inclined ways, located on the northwest and northeast corners of Union Terminal Freight Station No. 2, and which serve as passageways between the street level and the roof of the said terminal.
(y) Vehicle shall mean and include automobiles, trucks, buses, tractors, trailers, semi-trailers, horse-drawn carts or wagons and any other devices in or upon or by which any person or property is or may be transported, carried or drawn upon land, except railroad rolling equipment or other devices running only on stationary rails or tracks.
(z) Vehicular parking area shall mean that area of a truck terminal made available by the Port Authority for the parking of vehicles.
