Section 1025.19 - Radioactive materials

No vehicle shall enter the Queens Midtown Tunnel, the Brooklyn-Battery Tunnel or the Verrazano-Narrows Bridge Lower Level if its load includes any highway route controlled-quantity radioactive materials as defined by U.S.D.O.T. regulations, or any other radioactive material for which placarding is required by U.S.D.O.T. regulations, except:

(a) With respect to highway route controlled-quantity radioactive materials, when:
(1) a facility set forth hereinabove is a component of a preferred route selected in accordance with U.S.D.O.T. regulations and of a written route plan prepared in compliance with such regulations. The driver of a vehicle carrying such materials shall produce a copy of such written route plan to the facility supervisor for examination prior to entry upon the facility;
(2) the shipment complies with all packaging, labeling, placarding, quantity limitations and other applicable requirements of the U.S.D.O.T. regulations and the regulations of the Nuclear Regulatory Commission;
(3) the driver of such shipment has in his possession a certificate of training, certifying compliance with the training requirements of the U.S.D.O.T. regulations. Such certificate shall be provided to the facility supervisor for examination prior to entering upon the facility;
(4) if the shipment includes irradiated reactor fuel, the shipper provides physical protection as required by U.S.D.O.T. regulations and the regulations of the Nuclear Regulatory Commission; and
(5) the carrier has proof of financial responsibility in the amounts required by Federal regulations.
(b) With respect to other radioactive materials for which placarding is required, when:
(1) a facility set forth hereinabove is a component of a route selected by the carrier to minimize radiological risk in accordance with the U.S.D.O.T. regulations, taking into account accident rates, transit time, population density and activities, time of day and day of week during which transportation will occur;
(2) the shipment complies with all packaging, labeling, placarding, quantity limitations and other applicable U.S.D.O.T. requirements; and
(3) the carrier has proof of financial responsibility in the amounts required by Federal regulations.
