Section 1002.17 - Recovery of Interest

In any case where the corporation has paid interest under this Part and later determines that the interest was wrongly or incorrectly paid, whether because of a mistaken calculation of delay in payment or of interest due, or because the payment made, or any part of it, was not properly due to the contractor for any reason, or because of any other circumstance or state of facts, the corporation may recover the interest wrongly or incorrectly paid by means of a demand to the contractor for the repayment of the interest or a setoff against future payments to the contractor or by any other lawful means, including a court action or proceeding.
