Section 890.31 - Basinwide well registration standards and criteria
(a) Policy.
(1) All owners of individual wells or groups of wells operated as a system that withdraw an average of 10,000 gallons per day (gpd) or more during any 30-day period from the underground waters of the basin shall register their wells with the designated agency of the state where the well is located.
(2) Registrations may be filed by agents of owners, including well drillers.
(3) Owners of existing wells that withdraw 10,000 gpd or more in any 30-day period that have not been previously registered with the respective designated state agencies pursuant to state law or the Southeastern Pennsylvania Ground Water Protected Area Regulations shall register their wells with the designated state agency by March 1, 1986. In lieu of this provision, alternative arrangements for registration of previously unregistered existing wells may be approved by the executive director pursuant to section 890.33 of this Part.
(4) Any well that is replaced or redrilled, or modified in a manner such as to increase the withdrawal capacity of the well, shall be reregistered with the designated state agency.
(5) The following are the designated registration agencies for the respective states: Delaware Department of Natural Resources and Environmental Control; New Jersey Department of Environmental Protection and Energy; New York State Department of Environmental Conservation; and Pennsylvania Department of Environmental Resources.
(b) Forms, procedures and information requirements.
(1) Registrations shall be filed on forms and in accordance with procedures established by the commission. In lieu of such forms and procedures, the executive director may approve forms and procedures established by the respective State agencies which are essentially equivalent.
(2) The following data shall constitute minimum information requirements for well registration (owners or their agents are responsible for paragraphs [1]-[9]; states and/or the United States Geological Survey [U.S.G.S.] are responsible for paragraphs [10]-[13]):
(i) well identification number (owner ID);
(ii) well owner's name, address and telephone number;
(iii) well location:
(a) state;
(b) county;
(c) political subdivision; and
(d) U.S.G.S. quadrangle with location;
(iv) well construction information:
(a) date of well completion;
(b) driller's name, state license number;
(c) diameter(s) of hole (inches);
(d) depth drilled (feet below land surface);
(e) depth of completed well (feet below land surface);
(f) drilling method;
(g) casing(s):
(1) depth(s) (feet below land surface);
(2) diameter(s); and
(3) material;
(h) screen(s):
(1) depth(s) of top (feet below land surface);
(2) depth(s) of bottom (feet below land surface);
(3) diameter(s) (inches);
(4) material; and
(5) type;
(i) gravel pack:
(1) depth of top (feet below land surface);
(2) depth of bottom (feet below land surface);
(j) grout information:
(1) grout material;
(2) grout top (feet below land surface); and
(3) grout bottom (feet below land surface); and
(k) driller's log;
(v) water-yielding zones (consolidated-rock aquifers):
(a) depth of top (feet below land surface); and
(b) depth of bottom (feet below land surface);
(vi) pump test/well yield information:
(a) date;
(b) static water level (feet above or below land surface);
(c) pumping water level (feet below land surface);
(d) pumping time (hours and minutes);
(e) pumping rate (gpm);
(f) pumping measurement method; and
(g) maximum sustainable well yield;
(vii) use information:
(a) use type:
(1) agriculture (nonirrigation);
(2) commercial;
(3) domestic;
(4) industrial;
(5) irrigation;
(6) mining;
(7) dewatering;
(8) air conditioning, geothermal heat pump;
(9) power:
(i) fossil-fueled power; or
(ii) nuclear power;
(10) sewage treatment; and
(11) public water supply;
(b) anticipated or estimated usage (gpd, gpm or gpy);
(c) meter type;
(d) pump installation date;
(e) pump capacity (gpm);
(f) motor capacity (hp);
(g) pump manufacturer and type;
(h) power source(s);
(i) intake setting (feet below land surface); and
(j) current pumping level (if available);
(viii) manner and location of water or wastewater disposal;
(ix) verification: name, address, signature, date, and telephone number of person supplying data for paragraphs (1)-(8);
(x) identification and location:
(a) latitude and longitude (method used) or New Jersey grid number;
(b) major watershed (U.S.G.S. hydrologic unit);
(c) minor watershed;
(d) identification numbers (registration ID); and
(e) altitude (feet above or below mean sea level) (method used);
(xi) aquifer information:
(a) aquifer and geologic formation;
(b) lithology of aquifer;
(c) depth to bedrock;
(d) bedrock material;
(e) confined or unconfined aquifer; and
(f) specific capacity;
(xii) water-withdrawal permit data (if available):
(a) name of permitting agency;
(b) permit number;
(c) permit quantity; and
(d) expiration date; and
(xiii) verification: name, agency, address, date, and telephone number of person supplying data for paragraphs (10)-(12).
(3) The designated state agency may waive specific information requirements set forth in subdivision (b) of this section for existing wells if the information is unavailable.
(c) Administrative agreements. Recognizing the existence of ongoing well registration programs in the signatory states, and recognizing the major differences among the four signatory states regarding the legal authority and enforcement capability for the conduct of well registration, the executive director shall effectuate independent administrative agreements with each state for the conduct of well registration. The administrative agreements shall, at a minimum, provide for:
(1) the adoption by each state of the minimum information requirements presented in section 890.32 of this Part for registration of new wells producing an average of 10,000 gpd or more during any 30-day period and automation of well records;
(2) the identification and automation of well records for all registered, existing wells producing an average of 10,000 gpd or more during any 30-day period; and
(3) the adoption of procedures for registration of unregistered, existing wells producing an average of 10,000 gpd or more during any 30-day period and automation of well records.
