Section 5905.5 - Application requirementsPrior to completing the Federal SBIR Phase I research, a firm may submit to the executive director of the foundation an application for a State research contract, which shall contain the following information:
(a) A copy of the firm's complete Federal SBIR Phase I proposal.(b) A detailed description of a product based on the Phase I research that addresses a discernable market need and an analysis of the potential to produce, market, and service that product;(c) Certification by the firm that:(1) the firm is a corporation, partnership, sole proprietorship or individual, operating a business for profit, with 250 employees or less, including employees employed in any subsidiary or affiliated corporation, which otherwise meets the requirements of the Act;(2) all research to be conducted and supported by the State research contract award shall be performed solely in New York State;(3) no State research contract award shall be expended for travel, equipment, or facilities;(4) not more than one-third of State research contract award shall be used to contract for research and other related purposes;(5) the firm's principal place of business is and will remain in New York State during the conduct of Federal SBIR Phase II research.(d) A copy of the firm's most recent annual financial statement.N.Y.
