Section 5029.1 - Purpose and definitions
(a)Purpose.

This Part is intended to support and encourage the use of electronic signatures and electronic records in lieu of handwritten signatures and paper documents for the purposes of filing a system generated form, as required by the system, and received through the system interface.

(b) Definitions.

As used in this Part:

(1) The term electronic shall mean of or relating to technology having electrical, digital, magnetic, wireless, optical, electromagnetic, or similar capabilities.
(2) An electronic record shall mean information, evidencing any act, transaction, occurrence, event, or other activity, produced or stored by electronic means and capable of being accurately reproduced in forms perceptible by human sensory capabilities.
(3) The system interface shall mean system supported web applications (MyNYSTRS, the Employer Secure Area, and the NYSTRS Board Portal) or other such electronic means approved by the system.
(4) An electronic signature or digital signature means the creation of an electronic identifier (i.e., an electronic sound, symbol, or process, attached to an electronic record or logically associated with an electronic record and executed or adopted by a person with the intent to sign and submit the record) which the system determines is:
(i) unique to the signer;
(ii) capable of verification;
(iii) under the signer's control; and
(iv) linked to the record in such a manner that if the record is altered, the signature may be invalidated.
