Section 97.1 - Taxes on admissions(a) Sections 219, 306, 406, 1007(3)(e), 1008(4)(b) and 1009(5) of the New York State Racing, Pari-Mutuel Wagering and Breeding Law impose taxes equivalent to four percent of the admission prices to running, harness and quarter horse race meetings and the simulcasts thereof.(b) Each admissions tax must be paid to the Department of Taxation and Finance within 10 days after the close of the race meeting for which the admissions were charged. Provided, however, if a race meeting continues for a period of more than 30 days, the tax must be paid on or before the 10th day of each month for the previous month's admissions.(c) The payment of tax must be accompanied by a report showing the total amount of tax due and such other information as the department may require therein.(d) If the applicable admissions tax is not paid when due, a penalty of five percent and interest at the rate of one percent per month from the due date to the date of payment of the tax shall be payable to the department.N.Y.
