The law stated above provides the commissioner, with the approval of the director of the budget, shall establish and may amend regulations authorizing the payment of reasonable and necessary moving expenses of occupants of property acquired pursuant to this section, such payments not to exceed $300 in the case of an owner or tenant of residential property and $3000 in the case of an owner or tenant of commercial property. Such rules and regulations may further define the terms used in this subdivision and may provide for a schedule of payments in fixed amounts within the above limitations, in lieu of payments of reasonable and necessary actual moving expenses. Application for such payment shall be made to the commissioner upon forms prescribed by him and shall be accompanied by such information and evidence as the commissioner may require. Upon approval of such application, the commissioner shall deliver a copy thereof to the comptroller together with a certificate stating the amount due thereunder, and the amount so fixed shall be paid out of the State treasury after audit by the comptroller from moneys appropriated for the acquisition of property under this section. As used in this subdivision "commercial property" shall include property owned by an individual, family, business concern (including the operation of a farm) and a nonprofit organization. The following sections shall apply to making relocation payments to eligible persons for their moving expenses caused by their displacement from real property acquired pursuant to such law.
