Section 158.1 - General
(a) Section 380-a of the Vehicle and Traffic Law provides that it shall be unlawful to operate on any public highway any open truck or trailer being utilized for the transportation of earth, sand, stone or similar loose substances, unless said truck or trailer has a cover, tarpaulin or other device of a type and specification approved by the Commissioner of Transportation which completely closes in the opening on the said truck or trailer while said truck or trailer shall be so operated, so as to prevent the falling of any such substances therefrom. It also authorizes the commissioner to apply these provisions to specific conditions and loads.
(b) Section 380-a specifically provides that if the load is six inches below the top of the sides of such truck or trailer, the covering is not necessary.
(c) Section 380-a specifically exempts motor vehicles, trailers and semitrailers conveying "farm products" as defined in section 2 of the Agriculture and Markets Law from its requirements.
(d) For purposes of this Part, if any portion of the load, as measured laterally, is found to be above six inches below the sides of the truck transporting the load, such load shall be covered as provided in this Part.
(e) The commissioner hereby approves any cover, tarpaulin or other device, and the use thereof, which conforms with sections 158.2 and 158.3 of this Part.
