Section 79.2 - Compliance with rules and regulations a condition to entry upon or use of airport
(a) Any permission granted directly or indirectly, expressly or by implication, to any person or persons, to enter upon or use the airport or any part thereof (including aircraft operators, crew members and passengers, spectators, sightseers, and commercial vehicles, officers and employees of lessees or other persons occupying space at the airport, persons doing business with the airport operator, its subcontractors and licensees, and all other persons whatsoever whether or not of the type indicated), is conditioned upon compliance with these rules and regulations; and entry upon or into the airport by any person shall be deemed to constitute an agreement by such person to comply with said rules and regulations.
(b) The airport operator will evaluate any requests for permission or approval to engage in commercial activity at the airport against the following criteria:
(1) the capacity and needs of the airport and the needs of airport's users and the general public for the proposed service or activity;
(2) that the applicant, its principals and its employees are professionally qualified to perform the proposed service or activity up to the standards of the particular industry;
(3) that the applicant, its principals and employees possess all the necessary Federal, State and local approvals and licenses for the proposed service or activity;
(4) that the applicant and its principals can demonstrate sound financial responsibility and integrity, including certificates of insurance in an amount meeting the particular industry standards.
(c) The airport operator shall evaluate any requests for permission or consent other than to engage in commercial activity against the following criteria:
(1) the proposed activity must be able to be accomplished without danger to persons or property;
(2) the proposed activity must be in accord with applicable Federal, State and local law.
