Section 176.1 - Statement of purpose and applicability

(a) The purpose of this Part is to establish the procedures governing the issuance of declaratory rulings by the department pursuant to State Administrative Procedure Act section 204.

(b) Declaratory ruling means a statement described in State Administrative Procedure Act section 204(1) issued by the department with respect to:

(1) the applicability to any person, property, or state of facts of any rule or statute enforceable by the department; or

(2) whether any action by the department requires adoption as a rule pursuant to article 2 of State Administrative Procedure Act in order to be effective.
