Section 140.1 - Introduction
(a) Intent. Section 1198 of the Vehicle and Traffic Law establishes an ignition interlock program which authorizes courts in all counties of the State to require persons convicted of driving while intoxicated to equip their vehicles with an ignition interlock device. This Part establishes guidelines for the implementation of this program.
(b) Definitions.
(1) Ignition interlock device. Any blood alcohol concentration equivalence measuring device which connects to a motor vehicle ignition system and prevents a motor vehicle from being started without first determining through a deep lung breath sample that the operator's equivalent breath alcohol level does not exceed the calibrated setting on the device as required by 10 NYCRR Part 59.
(2) Program. As hereinafter used in this Part, the term program shall refer to the ignition interlock device program.
