Section 53.8 - Procedure for securing approval(a) A manufacturer desiring to secure approval of a formulation shall propose a manufacturer's identification to the commissioner prior to submitting a request for approval. If a manufacturer has already been assigned such an identification, he need not request a new identification, but should use such identification already assigned to him.(b) The manufacturer shall submit to the Commissioner of Motor Vehicles, Albany, New York, postage prepaid, a test report certified as required in section 53.7 of this Part, together with a sample of a brake lining manufactured from such formulation identified as required by section 53.6 of this Part.(c) If the commissioner finds that the formulation meets the requirements of this Part after receipt of the test report and sample, a notice of approval of the formulation will be issued. Such approval will approve that formulation within the coefficient of friction classification for which it was submitted and will apply to any properly identified brake lining made from such formulation unless otherwise specifically indicated.(d) In lieu of approval under subdivisions (a), (b) and (c) of this section, approval shall be deemed to be granted upon the receipt by the Commissioner of Motor Vehicles of a certificate of equipment approval issued by the American Association of Motor Vehicle Administrators to the Commissioner of Motor Vehicles, Bureau of Technical Assessment, Empire State Plaza, Albany, N.Y. 12228.N.Y.
