Section 53.10 - Provisions relating to certain original equipment brake linings(a) Original equipment brake linings manufactured or distributed prior to July 1, 1966, mounted on vehicles designated as 1967 or prior year models are exempt from the identification requirements of this Part.(b) Original equipment brake linings mounted on vehicles manufactured prior to July 1, 1966, and designated as 1966 or prior year models may be approved for the specific model vehicle on which such brake linings are mounted based upon road tests of such lining on such vehicle. If the same brake lining is used as a replacement lining on the same model vehicle, and approval under this section will also apply to such specific replacement use. Such road test must be conducted in compliance with SAE Recommended Practice J843d for passenger cars or J786 for trucks and buses, recording the following additions:(1) manufacturer's name and the formulation number of the lining; and(2) maximum weight carrying capacity of the vehicle as defined in the owners manual or sales specification, whichever is higher.(c) Approval will be granted on submission of evidence that performance data meets the requirements of SAE Recommended Practice J937b.(d) Certification of the accuracy of such test results may be made by the manufacturer or an independent testing agency.(e) The commissioner, in his discretion, may accept vehicle test reports other than those specified in subdivision (b) of this section upon submission of evidence that the tests submitted closely approximate the tests specified in subdivision (b) of this section and that it would be physically impracticable to comply with the test requirements of subdivision (b). Approval may be granted based upon such tests if, in the discretion of the commissioner, the performance data meets the equivalent of the requirements of SAE Recommended Practice J937b.N.Y. Comp.
