Section 45.4 - Procedure for securing approval

(a) One sample of the red emergency reflector warning device shall be shipped, postage prepaid, to the Commissioner of Motor Vehicles, Empire State Plaza, Albany, NY 12228, together with a certification from any unbiased laboratory acceptable to the commissioner, to the effect that the device meets the requirements of these specifications.

(b) In lieu of approval under subdivision (a) of this section, approval shall be deemed to be granted upon the receipt by the Commissioner of Motor Vehicles of a certificate of equipment approval issued by the American Association of Motor Vehicle Administrators to the Commissioner of Motor Vehicles, Bureau of Technical Assessment, Empire State Plaza, Albany, NY 12228.
