Section 603.13 - Glossary(a)Certification (certify). A statement that the copy is a true copy, as attested to, and documented by, the signature of the records access officer.(b)Factual tabulation. A collection of statements of objective information logically arranged and reflecting objective reality, actual existence or actual occurrence. Opinions, policy options and recommendations do not constitute factual tabulations.(c)Person/individual. An individual meeting appropriate admission criteria and receiving residential or nonresidential services at a program operated and/or certified by OPWDD. For the purposes of this regulation, this shall include persons who have applied, or are being screened, for any of the above services.(d)Record. Any information kept, held, filed, produced or reproduced by, with or for OPWDD in any physical form whatsoever, including but not limited to: reports, statements, examinations, memoranda, opinions, folders, files, books, manuals, pamphlets, forms, papers, designs, drawings, maps, photos, letters, microfilms, computer tapes or discs, rules, regulations or codes.(e)Records access appeals officer. That individual, or designee, who determines whether there is a legal basis for denying a request to access, amend or copy records.(f)Records access officer. That individual who receives and processes requests to access, amend or copy records.(g)Statistical tabulation. A record which is a collection or orderly presentation of numerical data logically arranged in columns, rows, or graphic representation. Opinions, policy options and recommendations do not constitute statistical tabulations.(h)Subject matter list. A reasonably detailed current list, by subject matter, of all records maintained by OPWDD, regardless of whether such records are available to the public pursuant to section 87(2) of the Public Officers Law.N.Y.
