Section 330.4 - Investigation and hearing procedure

In any investigation or hearing conducted before the Psychology Practice Committee pertaining to the revocation or suspension of the authority of a psychologist as provided under the Workers' Compensation Law, the following rules of procedure shall apply:

(a) The accused psychologist shall be given 30 days notice, in writing, containing a brief statement of the charge or charges against such psychologist and the time and place where such charge or charges will be heard. Such notice shall be served either personally or by mail. At least 10 days prior to the return date in said notice, the accused psychologist shall file an answer with the Psychology Practice Committee, answering the charges contained therein.

(b) On the hearing of such charge or charges, the accused psychologist shall be entitled to be represented by counsel and to cross-examine witnesses. Witnesses shall be placed under oath. A verbatim record of the proceedings shall be made.

(c) A true copy of the record of each proceeding shall be submitted to the chair along with the report, findings and recommendation of the Psychology Practice Committee.
