Section 622.3 - Daily commuting(a) A trainee, except as set forth under (b) below, who commutes daily to and from the training facility, including a trainee who receives subsistence allowances provided his choice for the location of his temporary residence is reasonable in view of factors such as living cost and availability of accommodations, shall be reimbursed for the cost of travel: (1) in amounts equal to the least expensive means of public transportation by common carrier reasonably available to him, or(2) if there is no public transportation that can reasonably meet his needs, in an amount calculated by multiplying by five cents the mileage of the most direct route from his residence, provided, however, that the cost so established may be reduced by 50 cents for each round-trip, with a maximum reduction by $2.50 per week.(b) No transportation allowances for daily commuting within a commuting area shall be paid to a trainee engaged in on-the-job training for any week in which he has been offered by the on-the-job employer compensated work for a full work week customary in the industry for the occupation to which his training relates.N.Y.
