Section 620.2 - Regular allowances
(a) Basic amount. The weekly regular basic State training allowance payable with respect to weeks beginning in a calendar quarter to a trainee shall be an amount equal to the State-wide average gross benefit rate for four effective days which obtained under the Unemployment Insurance Law for the first four of the last five preceding calendar quarters, with fractions of a dollar rounded up to the next higher multiple of a dollar.
(b) Augmentation.
(1) For dependents. Weekly regular allowances shall be augmented by $5 for each dependent, up to a maximum of six, whom the trainee supports, excepting dependents who receive State training allowances as here provided or any other similar training allowances from any public fund.
(2) After 10th week of training. Weekly regular allowances shall be augmented after the 10th week of training:
(i) by $10 for trainees who do not receive any augmentation for dependents;
(ii) by $5 for trainees who receive an augmentation for one dependent.
(c) Reductions. Regular allowances shall be reduced in any week by the amount of:
(1) unemployment benefits to which the trainee is or would be entitled under the New York State Unemployment Insurance Law, the provisions for unemployment compensation for former Federal civilian employees and exservicemen (Chapter 85, title 5, U.S. Code), or any other State or Federal Unemployment Compensation Act;
(2) earnings in employment, not connected with the training, for work in excess of 20 hours during the week;
(3) a sum equivalent to 1/40 of the training allowance for each compensated hour of work spent during the week in on-the-job training under the training program;
(4) any other training allowance or training assistance payable to the trainee from any public fund;
(5) a sum proportionate to the days of unexcused absence from the training facility.
(d) Duration. Regular allowances shall be payable for a period not exceeding 104 weeks with respect to any training program to which the trainee has been referred.
