Section 410.1 - Definitions(a) Scheduled short-term care in a nursing home shall mean scheduled short-term nursing home care provided on a temporary basis to an individual who needs this level of care but who is normally cared for in the community. The goal of scheduled short-term care is to provide relief for the caregiver(s) while providing nursing home care for the individual. Schedules for scheduled short-term care are generally pre-arranged and shall be limited to one or more periods of from one to 30 days and shall not exceed 42 days in any one year except in extraordinary circumstances, such as sudden illness of the primary caregiver or temporary unfitness of the individual's principal residence.(b) A caregiver shall mean a family member or other person who routinely provides the daily care or supervision of the individual in the home.N.Y.
