Notwithstanding any other regulation, the department may approve providers which have medically acceptable protocols to screen blood of newborns, or with consent, the mother's blood, for human immunodeficiency virus antibodies and to communicate the results of such screening test to the mother or, if the mother lacks capacity to consent to health care for the newborn, to the person authorized by law to give such consent.
