The testing requirements of this Subpart shall not apply if the chief executive officer of a hospital providing care to the newborn or the newborn's birth attendant determines that the newborn's parent(s) hold genuine and sincere religious beliefs contrary to the testing required by this Subpart, and the parent(s) have provided satisfactory written documentation of such religious beliefs. In such instances, within five days of a newborn's birth the chief executive officer or birth attendant shall submit such documentation to the testing laboratory, along with an attestation that the parent(s) received education regarding the benefits of newborn screening.
