If review of the documentation outlined above justifies a waiver, the state agency will publish a notice of intent to grant such a waiver, outlining the state agency's justification for the proposed action. This notice will provide a thirty (30) day comment period during which time an individual or a service provider from the area may request a hearing by the state agency on the pending waiver request. At the end of the thirty (30) day comment period, if no hearing has been requested, the state agency's decision to grant the waiver will become effective and the state agency will notify the area agency of the decision in writing within five (5) working days.
