Section 8.26.3.12 - CONFIDENTIALITY OF RECORDS PRIOR TO ENTRY OF DECREEA. See Section 32A-5-8 NMSA 1978.B. ICWA intervenors: (1) Access to confidential records: All ICWA intervenors shall have access to the confidential records in the adoption of an Indian child.(2) Confidentiality: All ICWA intervenors shall comply with the confidentiality requirements of Section 32A-5-8 NMSA 1978.C. Affidavit for release of parent information: Prior to the entry of a decree of adoption, the attorney for the petitioner shall file with the court on behalf of the consenting or relinquishing party an affidavit for release of parent information form.D. In a termination of parental rights proceeding, the attorney for the petitioner shall attempt to obtain from the biological parent an affidavit for release of parent information form.E.
