All Children's Crisis Shelters, Multi Service Homes, Community Homes, and New or Innovative programs that provide children's services as specified in these regulations. Community Homes licensed under these regulations are subject only to Sections 7.8.3.1 through 7.8.3.5; Sections 7.8.3.7 through 7.8.3.9; Sections 7.8.3.11 through 7.8.3.24; and Sections 7.8.3.82 through 7.8.3.127 of these regulations. Community Homes are exempt from all references to the word 'welfare' in these regulations.
A. These regulations apply to the following: (1) Public or private, profit or nonprofit residential facilities providing services as outlined by these regulations.(2) Any facility providing services as outlined by these regulations which by State or federal law or regulation must be licensed by the State of New Mexico.B. These regulations do not apply to the following:(1) Offices and treatment room of licensed private practitioners.(2) Agencies providing Treatment Foster Care Services which are licensed by the Protective Services Division of the Department.(3) Room and board facilities in public or private schools accredited or supervised by the New Mexico State Department of Education and inspected for fire and safety by the New Mexico State Fire Marshal's office.(4) Residential Treatment Services and Day Treatment Services that provide Children and Adolescent Mental Health Services, which are licensed by Children, Youth and Families Department, Certification Unit.N.M.
