Section 7.36.2.19 - CURRENTLY LICENSED FACILITIESAny ESRD facility currently licensed on the date these regulations are promulgated and which provides the services prescribed under these regulations, but which fails to meet all building requirements, may continue to be licensed if:
A. variance may be granted for those building requirements the ESRD facility cannot meet provided the variances granted will not create a hazard to the health, safety and welfare of the patients and staff, and are not in violation of current fire and building codes;B. the building requirements for which variances are granted cannot be corrected without an unreasonable expense to the ESRD facility; andC. variances granted will be recorded and made a permanent part of the end stage renal disease facility file.5/7/91; Recompiled 10/31/01
