The intermediate sanctions set out in Subsections 8.1 - 8.5 of Section 8 [now Subsections A - E of 7.1.8.8 NMAC] may be imposed on an emergency basis when there exists an immediate threat to human health and safety. An administrative hearing will be schedule within five (5) working days, unless waived by the facility. A request for a hearing does not stay the imposition of the emergency sanction.
