Section 20.2.70.301 - CONFIDENTIAL INFORMATION PROTECTIONA. All confidentiality claims made regarding material submitted to the Department under this Part shall be reviewed under the provisions of the New Mexico Air Quality Control Act section 74-2-11 NMSA 1978 and the New Mexico Inspection of Public Records Act, sections 14-2-1 et seq. NMSA 1978.B. In the case where an applicant or permittee has submitted information to the Department under a claim of confidentiality, the Department may also require the applicant or permittee to submit a copy of such information directly to the Administrator.C. An operating permit is a public record, and not entitled to protection under section 114(c) of the Federal Act.N.M. Code R. § 20.2.70.301
