Any person who intends to conduct coal exploration activities outside a permit area on lands designated as unsuitable for surface mining under all of 19.8.2, 19.8.3 and 19.8.4 NMAC shall submit an application and shall obtain written approval from the director. Any person who receives approval from the director for such activities shall comply with 19.8.19 NMAC.
