Section 8:57A-1.15 - Hearings

(a) Upon request, a hearing shall be afforded to a health care facility, physician, dentist or other health care provider pursuant to 8:57A-1.14.

(b) A health care facility, physician, dentist or other health care provider shall notify the Department or its designee, in writing, of its request for a hearing within 30 days of receipt of a Notice of Violation and Penalty Assessment.

(c) The Department or its designee shall transmit the hearing request to the Office of Administrative Law, which will conduct the hearing pursuant to the Administrative Procedure Act, 52:14B-1 et seq., and the Uniform Administrative Procedure Rules, N.J.A.C. 1:1.
