Section 8:33C-2.9 - Distribution of intermediate and intensive bassinets

(a) Regional Perinatal Centers or Community Perinatal Centers-Intensive shall provide neonatal intensive care. The final allocation of such bassinets shall be made by the Commissioner through the certificate of need review process.

(b) The minimum size of any neonatal intensive care unit shall be six bassinets. The minimum size of any neonatal intermediate care unit shall be four bassinets. Waiver of the minimum size of a neonatal intermediate care unit may be obtained from the Commissioner in cases where geographic inaccessibility is demonstrated and where no additional costs will be incurred. Waiver of the minimum size of a neonatal intensive care unit is not available and none shall be granted. Applicants seeking a waiver shall follow the process set forth at 8:33C-4.4(c).
