Section 8:17-5.4 - Criteria for terminating appointment of a surrogate parent

(a) The Department shall terminate the appointment of a surrogate parent if:

1. The child ceases to meet the eligibility criteria identified in 8:17-5.1 for needing a surrogate parent;

2. The child ceases to participate in the early intervention system; or

3. The surrogate parent ceases to meet the eligibility criteria identified in 8:17-5.2 or the surrogate parent requirements in 8:17-5.3.

(b) The Department shall not terminate a surrogate parent in retaliation for the surrogate parent exercising his or her rights or the rights of the child pursuant to 8:17-5.3.
