Section 8:121-1.9 - Waiver
(a) Waivers of specific rules shall be considered, at the discretion of the Department, provided that, in the opinion of the Director, the waiver is justified as outlined below, would not impair the effective and efficient provision of mental health services within the system of care, and would not endanger or adversely affect the life, safety, or welfare of clients.
(b) Requests for waiver shall be made in writing to the Director. The written request for waiver shall include the following:
1. The specific rule(s) or part(s) of the rule(s) for which the waiver is requested;
2. Reasons for requesting a waiver, including a statement of the type or degree of hardship that would result to the program if a waiver were not granted;
3. Clear clinical or programmatic justification for such a waiver; and
4. Documentation to support the request of waiver.
(c) The Department reserves the right to request additional information before processing a request for waiver.
