Section 8:28-4.2 - Penalties

(a) A person who violates any of the provisions of the Act, except as provided in (b) below, is subject to a penalty of $ 100.00 for the first offense and $ 200.00 for each subsequent offense, in accordance with 26:2D-87.

(b) A person who violates any of the provisions of the Act concerning a minor's use of a tanning facility is subject to a penalty of $ 1,000 for the first offense, $ 2,000 for the second offense, and $ 2,000 and a five-day suspension of the facility's registration and operation for third and subsequent offenses, in accordance with 26:2D-87.
