N.J. Admin. Code § 7:8-2.5

A municipality or other entity conducting stormwater management planning under this chapter may petition the Department at the address provided at 7:8-1.3 for an exemption to the requirements of this chapter by submitting documentation to demonstrate that, if granted, the exemption will not result in an increase in flood damage, water pollution, including threats to the biological integrity, or constitute a threat to the public safety.
