Section 7:7-6.2 - General permit 2 - activities on a beach and dune
(a) This general permit authorizes the following activities on a beach and dune:
1. Routine beach maintenance activities performed in accordance with N.J.A.C. 7:7-10.2;
2. Emergency post-storm beach restoration performed in accordance with N.J.A.C. 7:7-10.3;
3. Dune creation and maintenance performed in accordance with N.J.A.C. 7:7-10.4; and
4. The construction of dune walkovers constructed in accordance with N.J.A.C. 7:7-10.4(e) and(f).
(b) The activity shall not be conducted in any wetlands.
(c) Public access to the beach shall be provided in accordance with the lands and waters subject to public trust rights rule, 7:7-9.48, and the public access rule, 7:7-16.9.
(d) The activity is conducted in accordance with the Operation and Maintenance Manual associated with the Federal or State project, or where such manual does not exist, the activity does not compromise the design template of the engineered beach and/or dune.
(e) The activity complies with any applicable management plan for protection of State and Federally listed threatened or endangered species, as approved by the Department and the USFWS, and/or the endangered or threatened wildlife or vegetation species habitat rule, N.J.A.C. 7:7-9.36.
(f) As of November 5, 2015, the Department shall not approve authorization under this general permit to any municipality that does not have a Department-approved municipal public access plan in accordance with 7:7-16.9(c) through (m).
