Section 7:28-12.15 - Requirements pertaining to onsite burial or capping

(a) No owner or licensee shall bury or construct an engineered barrier (cap) over radioactive material onsite unless the requirements of 7:28-12.8 and 12.11 are met.

(b) Owners or licensees with sites that have been used for burial of radioactive materials or where radioactive material has been capped, shall not be allowed to convert these sites to other uses unless the requirements of 7:28-12.8 and 12.11 are met.

(c) The owner or licensee of any burial ground or capped material shall notify the Department in writing not less than 30 days in advance of any transfer of title to the property involved.
