Section 7:12-9.14 - Permit for a Hatchery to Produce and Grow Seed or for a Nursery to Grow Seed
(a) The Permit for a Hatchery to Produce and Grow Seed or for a Nursery to Grow Seed authorizes a hatchery or nursery to produce and/or grow seed at a single site in or using waters classified as other than Approved for sale or for relocation to Approved or Conditionally Approved waters.
(b) In addition to the completed Consolidated Permit Application form and application fee required under 7:12-9.3, an applicant for a Permit for a Hatchery to Produce and Grow Seed or for a Nursery to Grow Seed shall submit a detailed description of the operation that includes the following:
1. The name(s) and location(s) of the waters where the operation is to be conducted and the classification(s) of those waters under this chapter;
2. A description of the methods and equipment to be used to produce and/or grow seed;
3. The species of seed to be produced and/or grown;
4. If hatchery activities are conducted, the species and number of broodstock and the physical location of the broodstock at all times; and
5. If hatchery activities are conducted, a description of security measures that limit access to the broodstock. Such measures may include locked structures or cages, surveillance, patrols, and/or fencing.
(c) A Permit for a Hatchery to Produce and Grow Seed or for a Nursery to Grow Seed is subject to the following specific requirements and conditions:
1. The permittee shall conduct production and/or growing activities only in the location(s) specified in the issued permit document.
2. The permittee shall not make any changes to its operations without prior written approval from the Department, including, for a hatchery, increasing the quantity of broodstock or moving broodstock to a location other than that specified in the issued permit document.
3. The permittee is responsible for informing its employees involved in seed production and/or growing activities that any collected shellfish shall not be used for human consumption and of the risks associated with consumption of shellfish from waters classified other than Approved.
4. The permittee shall immediately telephone the Department at (877) WARN DEP (927-6337) regarding any theft of broodstock.
5. The permittee shall immediately telephone the Department's Division of Fish and Wildlife, Bureau of Law Enforcement, Marine Region at 609-748-2050 regarding any theft of seed or significant seed mortality.
6. A nursery shall not have any broodstock or shellfish above seed.
7. A hatchery shall not have broodstock in numbers greater than specified in the issued permit document. Any broodstock shall be used only for the purposes of producing seed. Broodstock shall not be sold for human consumption.
