Section 7:10-13.3 - Demonstration of technical capacity for community water systems

(a) An applicant for a permit to construct and operate a new public community water system pursuant to 7:10-11.5(a) shall, in addition to requirements set forth in 7:10-11.5(d), provide a detailed description of source of supply, treatment, storage, and distribution of the new water system's infrastructure, which shall include the following:

1. Identification and evaluation of all critical facilities and equipment whose failure would result in a water outage or water quality failure;

2. Evidence, including a description, of any deeds, leases or easements for land, water supply sources, or physical facilities used in the operation of the system; and

3. Evaluation of the feasibility of connecting to any adjacent water systems and justification why these connections should not be required.

(b) An applicant for a permit to construct and operate a new public community water system pursuant to 7:10-11.5(a) shall submit an Infrastructure Replacement Plan that includes:

1. A description of and estimate of life expectancy of all sources of water supply, treatment, and transmission/distribution facilities including pipes, pumping stations, storage facilities, and meters; and

2. An equipment replacement plan including expected replacement date, costs, and sources of funding.

(c) An applicant for a permit to construct and operate a new public community water system pursuant to 7:10-11.5(a) shall submit proof of compliance with State operator certification rules, N.J.A.C. 7:10A.
