Section 6A:9B-7.6 - Substitute credential for exchange teachers

A district board of education employing a teacher from another state or another country as an exchange teacher in accordance with N.J.A.C. 6A:9B-5.11(c) shall request that the Board of Examiners issue a substitute credential to the exchange teacher, pursuant to N.J.A.C. 6A:9B-5.11(c). The exchange teacher may serve for up to one year, pursuant to N.J.A.C. 6A:9B-5.11(a).

Even though a Florida-certified teacher was misinformed by an employee of the N.J. Department of Education as to the minimum acceptable GPA that had to be met in order to obtain a Certificate of Eligibility with Advanced Standing (CEAS) in New Jersey, the Board of Examiners did not err in denying her application for a CEAS because governing law provided that the Board could not waive the requirement of a 2.75 GPA. Nor did the applicant take steps to supplement her GPA by submitting a qualifying Praxis score. That said, the teacher might well have a separate claim for equitable fraud. Flynn v. N.J.
