Section 6A:30-7.2 - Procedure for transition to partial State intervention or to local control
(a) If the Commissioner determines a school district under State intervention has satisfied the factors at N.J.A.C. 6A:30-7.1(b) for one or more components of school district effectiveness, the Commissioner shall recommend to the State Board that the process for withdrawal from intervention be initiated. Based on the Commissioner's recommendation, the State Board may grant approval for the Department to initiate the transition to local control in those components of school district effectiveness for which the school district satisfied 80 to 100 percent of the weighted quality performance indicators and shows evidence the progress will be sustained.
1. This section's procedures regarding transition to partial State intervention or to local control also shall apply to school districts that were State-operated prior to February 22, 2007.
(b) If the State Board grants approval to initiate the transition to withdrawal from State intervention, the Commissioner shall notify the school district of the State Board's decision.
(c) As an initial step in the transition process, the Department shall develop, in collaboration with the school district, a transition plan that shall contain the components at N.J.A.C. 6A:30-7.3 and shall address the transition to local control of the component(s) for which the school district has met the requirements of N.J.A.C. 6A:30-7.1(b).
