Section 5A:1-1.3 - Office of the Adjutant General(a) The Adjutant General, a member of the Governor's Cabinet, is the Chief Executive Officer of the Department and oversees all functions of the Department of Military and Veterans' Affairs. Concurrently, he or she is appointed as a General Officer in the New Jersey National Guard in accordance with N.J.S.A. 38A:3-3 and serves as the commander of the State's military forces under the direction of the Governor, pursuant to N.J.S.A. 38A:3-6(d).(b) The Deputy Adjutant General is one of two deputies to the Adjutant General. The Deputy Adjutant General oversees the general operations of the Department as directed by the Adjutant General and acts in the place of the Adjutant General in his or her absence. In addition to all other requirements, he or she may be appointed as a General Officer in the New Jersey National Guard in accordance with N.J.S.A. 38A:3-5.(c) The Administrator of Veterans Affairs is one of two deputies to the Adjutant General. The Administrator oversees the general operations of the veterans' programs for the Department and in the performance of this duty carries the title of Deputy Commissioner of Veterans Affairs. The Deputy Commissioner must be an honorably discharged veteran of the Armed Forces of the United States in accordance with N.J.S.A. 38A:3-4.1.(d) The Adjutant General, as the commander of the State's military forces, is assisted in their operations by the Deputy Adjutant General, the Assistant Adjutants General, the Chief of the Joint Staff, and the Chiefs of Staff for Army and Air.(e) The senior commanders of the State's military forces, which are hierarchical military organizations, report directly to the Adjutant General in matters regarding their commands.(f) In matters relating to Federal resources directed at supporting the State's military forces, the Adjutant General is assisted and advised by the United States Property and Fiscal Officer in accordance with 32 U.S.C. § 708.(g) In the normal course of events, the following special staff reports directly to the Adjutant General in their respective areas:1. The Deputy Adjutant General;2. The Chief of the Joint Staff;3. The Assistant Adjutant General--Army;4. The Assistant Adjutant General--Air;5. The Senior Army Advisor;6. The Inspector General;7. The Chief of Staff--Army;8. The Chief of Staff--Air;9. The Command Sergeant Major;10. The Command Chief Master Sergeant;11. The Command Chief Warrant Officer;12. The Judge Advocate General addresses Federal legal issues;13. The State Attorney General's office and the assigned Deputy Attorney General address State legal issues;14. The Director of Homeland Security; and15. The United States Property and Fiscal Officer.(h) The following commissions and councils advise the Adjutant General directly on matters within their respective areas of interest: 1. Agent Orange Commission;2. New Jersey Veterans' Memorial Home--Menlo Park Advisory Council;3. New Jersey Veterans' Memorial Home--Paramus Advisory Council;4. New Jersey Veterans' Memorial Home--Vineland Advisory Council;5. Veterans' Services Council;6. Brigadier General William C. Doyle Veterans Memorial Cemetery Advisory Council;7. Veterans Haven South Council;8. Veterans Haven North Council;9. Commission on Women Veterans; and10. Post-Traumatic Stress Disorder Veterans Task Force.N.J. Admin. Code § 5A:1-1.3
