Section 5:73-1.4 - Definitions

The following terms shall have the meanings indicated, except where the context clearly requires otherwise.

"Acquired building" means any structure acquired by the eligible organization from a property owner for the purpose of conducting live fire training exercises.

"Commissioner" means the Commissioner of the Department of Community Affairs or his or her delegate.

"Department" means the Department of Community Affairs.

"Division" means the Division of Fire Safety of the Department of Community Affairs.

"Eligible organization" means a fire department or district, or a combination of fire departments or districts, a fire brigade, an institution of higher learning, the New Jersey State Fire College or a recognized governmental entity which has been approved by the Division to offer courses or modules which meet the requirements of this chapter.

"Evolution" means a set of prescribed actions that result in an effective fireground activity.

"Fire investigator" means a qualified person who enters the fire scene after fire suppression has been completed, and through the use of a systematic and approved scientific methodology, determines the origin, cause, and responsibility of a fire.

"Fire police officer" means any member of a duly organized volunteer fire company who has the duty for performing traffic control, scene security, and other related duties at the scene of a public event, fire, fire drill or any other similar occasion.

"Fire service" means the State, a county or municipal agency or fire district utilizing volunteer, career or part-paid firefighters for rescue, fire suppression and related activities.

"Fire service instructor" means a career or volunteer or part-paid firefighter who has been certified by the division to deliver firefighter training after completing a prescribed curriculum. For purposes of this chapter, "fire service instructor" shall not include instructors of wildland and forestland firefighters in the State forest fire service.

"Fire service training organization" means any State, county or municipal agency or other entity, either public or private, which trains firefighters.

"Firefighter I" means any person who has the duty of performing fire suppression, rescue and hazardous material response for a public event, emergency management incident, fire, fire drill or any other similar occasion and who has completed a prescribed firefighter instructional program consistent with N.J.A.C. 5:73-4.3(a). For purposes of this chapter, "firefighter I" shall not include State forest fire service firefighters.

"Firefighter II" means any person who has the duty of performing fire suppression, rescue and hazardous material response for a public event, emergency management incident, fire, fire drill or any other similar occasion and who has completed a prescribed firefighter instructional program adopted by the Office of Training and Certification. For purposes of this chapter, "firefighter II" shall not include State forest fire service firefighters.

"International Fire Service Accreditation Congress (IFSAC)" means the non-profit organization that is a peer-driven, self-governing system of both fire service certification programs and higher education fire-related degree programs.

IFSAC's mission is to plan and administer a high-quality, uniformly delivered accreditation system with an international scope. The IFSAC administrative office may be contacted by writing to: IFSAC, 1812 Tyler Avenue, Stillwater, OK 74078.

"Live fire" means any open flame or device that can propagate fire to a building or other combustible materials.

"Live fire training" means training that involves any open flame or device that can propagate fire.

"National Board on Fire Service Professional Qualifications" ("NBFSPQ" or "Pro Board") means the non-profit organization, which was founded solely to enhance the job performance and credibility of those individuals within the fire service and allied professions. "Non-permanent fire service training facility" means any building, or group of buildings, or areas, or mock-ups not specifically designed for firefighter training evolutions and not utilized as a fire training facility on a regular or continual basis including, but not limited to, acquired buildings and motor vehicles.

"Permanent fire service training facility" means any building or group of buildings, or areas, or mock-ups specifically designed for firefighter training evolutions and utilized as a fire training facility on a regular or continual basis.

"Shall" indicates a mandatory requirement.

"Should" indicates a recommendation or that which is advised but not required.

"Supervisor" means fire service personnel who have supervisory authority and responsibility over other personnel.
