Section 3A:40-5.1 - Appeals(a) An applicant may appeal the CSOC's determination of ineligibility using the process set forth in N.J.A.C. 3A:5-4.1.(b) The applicant bears the burden of proof and burden of persuasion in an appeal of the CSOC's determination of ineligibility.(c) When the ineligibility determination is made by the Division of Developmental Disabilities, the appeal is filed with that agency pursuant to N.J.A.C. 10:48. The CSOC accepts the final outcome of that litigation if the applicant is under 21 years of age.N.J. Admin. Code § 3A:40-5.1
