Section 19:61-3.5 - Allegation before State agency(a) An allegation of a violation by a State official of the uniform ethics code or a code, rule, or regulation promulgated by a State agency pursuant to the provisions of 52:13D-12 et seq., may be filed with the State agency employing said State official in accordance with the procedures established by the agency to process such allegations.(b) Every allegation received by a State agency in accordance with (a) above shall be forwarded to the Commission along with a memorandum stating whether the agency will conduct a preliminary investigation or refer the matter to the Commission. 1. Any preliminary investigation by a State agency shall be confidential.2. At the completion of a preliminary investigation conducted by a State agency, a summary of the agency's findings must be forwarded to the Commission along with the agency's recommendation on the matter.(c) It shall be within the discretion of the Commission to direct the State agency to transfer the allegation to it in accordance with 19:61-3.1.N.J. Admin. Code § 19:61-3.5
