Section 16:44B-6.2 - Proposal receipt, rejection, and withdrawal(a) Unless and until a proposal is accepted, the drawings, specifications, and other information in the proposal shall remain the property of the design-builder. Once a proposal is accepted, the disclosure of the proposal and the information in the proposal, and the ownership of the drawings, specifications, and other information in the proposal, shall be determined in accordance with existing law and the terms of the design-build contract.(b) The Department will have the right to reject any and all proposals. The Department may issue a new solicitation using the same evaluation factors, budget constraints, or qualifications, unless there has been a material change in circumstances affecting the needs of the Department including, but not limited to, an environmental issue, natural disaster, state of emergency, or unforeseen fiscal constraint.(c) A proposal submitted pursuant to N.J.S.A. 52:35B-1 et seq., may be withdrawn for any reason at any time prior to acceptance.N.J.
