Section 16:41-5.4 - Review time for applications(a) The Department shall process a completeness check of an application within 45 days of the Department's receipt thereof, in accordance with N.J.A.C. 16:41-5.6(a). Upon the Department's determination that an application is complete, the Department shall have a maximum application review time of 45 days within which to approve or deny the application. This review time shall apply only to the Department and does not include any applicant time or time for Federal Highway Administration reviews of activity on Interstate highways, interchanges, or ramps. The Department may extend this review time for permits for longitudinal installations of private facilities over 660 feet long and for the longitudinal installations of underground fiber optic facilities over 1,320 feet long.(b) The Department's application review time for a particular application may be extended upon the written consent of the applicant.(c) Whenever the Department requests supplemental information from the applicant, the step in the process and its associated time frame shall restart once the Department receives the information. When an applicant fails to respond to a Department request for supplemental information within 90 days of the request, the Department shall consider the application to have been withdrawn.N.J. Admin.
