This subchapter implements the provisions of 58:11-59 et seq., commonly known as the "Small Water Company and Small Sewer Company Takeover Act." This subchapter establishes procedures by which a small water company or small sewer company that does not comply with applicable statutory and regulatory standards concerning the availability and quality of potable water or the discharge of treated sewage to the State's waters may be acquired or "taken over" by a public or private entity pursuant to a joint order issued by the New Jersey Department of Environmental Protection and the New Jersey Board of Public Utilities.
