Section 13:69A-9.21 - Fees to recoup costs of the Division or Commission

(a) Pursuant to section 141.1 of the Act, the Division is authorized to promulgate rules for the recoupment of costs of services, equipment, or other expenses that are rendered, utilized, or incurred by the Division or Commission, including the reimbursement of any unusual or out-of-pocket expenses directly related thereto, on an actual cost basis for such services, equipment, or other expenses in response to requests arising pursuant to the Act that are unrelated to the investigation or consideration of the issuance, renewal, or resubmission of a license or registration from casino facilities and, as to sports wagering, racetracks that host sports wagering facilities and activities.

(b) The amount of the fees charged for the costs of services, equipment, or other expenses rendered, utilized, or incurred by the Division or the Commission, pursuant to section 141.1 of the Act, shall be equal to the actual cost of such services, equipment, or other expenses. The fees shall be billed on a monthly basis or as otherwise determined by the Division.

(c) For the purposes of this subsection, services rendered, utilized, or incurred by the Division or Commission include, but are not limited to, regular, special, and other contractual services for law enforcement performed pursuant to memoranda of understanding or other agreements between the Division and the New Jersey Department of Law and Public Safety, the New Jersey State Police, or the Division of Criminal Justice, contractual agreements related to information technology, and agreements for industry-wide analyses. The fees allocated to casino facilities and, as to sports wagering, racetracks that host sports wagering facilities and activities shall be equal to the actual cost of the services that are rendered, utilized, or incurred pursuant to memoranda of understanding or other agreements to be recouped by the Division in accordance with this subsection and shall be billed among all casino licensees and, as to sports wagering activities, racetrack sports wagering facilities.

(d) For the purposes of this subsection, equipment and other expenses rendered, utilized, or incurred by the Division or Commission include, but are not limited to, equipment, supplies, lease arrangements, and other like expenses. The fees allocated to casino facilities and, as to sports wagering activities, racetracks that host sports wagering facilities and activities for equipment, supplies, lease arrangements, and other like expenses shall be equal to the actual costs of same that are rendered, utilized, or incurred by the Division or Commission and shall be recouped by the Division in accordance with this section.
