Section 11:4-34.1 - Purpose and scope(a) The purpose of this subchapter is to implement the New Jersey Long-Term Care Insurance Act, P.L. 2003, c. 207, codified at 17B:27E-1 et seq., and to promote the public interest and the availability of long-term care insurance coverage, to protect applicants for long-term care insurance, as defined in this chapter, from unfair or deceptive sales or enrollment practices, to facilitate public understanding and comparison of long-term care insurance coverages, and to foster flexibility and innovation in the development of long-term care insurance.(b) Except as otherwise specifically provided, this subchapter applies to all long-term care insurance policies, certificates and riders, including qualified long-term care contracts, disability income policies with long- term care benefits, and life insurance policies, annuity contracts, certificates and riders that accelerate death benefits for long-term care or provide long-term care as an additional insured benefit or as a form of surrender benefit, that are delivered or issued for delivery in this State by insurers, fraternal benefit societies, and health, hospital and medical service corporations. Certain provisions of this subchapter apply only to qualified long-term care insurance contracts as noted.
